Telehealth Consent

For purposes of this page, "Surfbound," "Surfbound Health," "we," "us," and "our" refer to Open Water Rx LLC, doing business under the Surfbound and Surfbound Health trade names.

Consent to Telehealth

By using Surfbound, you consent to receive healthcare services through telehealth. Telehealth uses electronic communications to connect you with licensed providers who review your health information remotely. You understand that telehealth visits are different from in-person visits and have certain limitations.

Telehealth Limitations

Telehealth evaluations rely on the information you provide. Providers cannot perform physical examinations through telehealth. Telehealth may not be appropriate for every condition, person, or situation. Certain conditions may require in-person evaluation and cannot be treated through telehealth. Your provider will determine whether telehealth is appropriate for you based on the information you provide and applicable standards of care.

Provider-Patient Relationship

A provider-patient relationship is formed only when a licensed provider accepts and reviews your health information as required. Completing an online intake alone does not create a provider-patient relationship. Providers practice independently and are responsible for their own medical judgment and treatment decisions.

Accurate Health Information

You must provide accurate and complete health information during your intake. You agree to disclose your medical history, current medications, allergies, conditions, and other relevant health information truthfully. Withholding or misrepresenting health information may affect the safety and appropriateness of treatment and may result in treatment being denied or discontinued.

No Emergency Care

Surfbound is not for emergencies. If you are experiencing a medical emergency, call 911 or seek emergency care immediately. Telehealth services through Surfbound do not replace emergency or urgent care. Do not delay seeking emergency care because of your use of Surfbound.

No Guaranteed Prescriptions

Prescriptions are not guaranteed. Treatment is prescribed only when a licensed provider determines it is medically appropriate. A provider may approve treatment, deny treatment, request more information, recommend a different treatment option, or advise you to seek in-person care. Completing an intake and paying for a provider review does not guarantee a prescription.

Prescription Medications

If prescribed, medication may be sent to a licensed pharmacy or fulfillment partner for processing and shipment. Prescription medications cannot be returned, reused, or resold once dispensed or shipped. You are responsible for using medications as directed by your provider and for reading all provided information about your treatment.

Compounded Medications

Some treatment options may involve compounded medications. Compounded medications are not FDA-approved. They are prescribed only when a licensed provider determines they are medically appropriate for you. Compounded medications are prepared by licensed pharmacies and are not evaluated by the FDA for safety, effectiveness, or quality.

Risks and Side Effects

All medications carry potential risks and side effects. Your provider will discuss relevant risks and side effects as part of the informed consent process. You should review all medication information provided with your treatment and contact your provider or seek medical attention if you experience unexpected or concerning symptoms.

Technology Risks

Telehealth involves electronic transmission of health information. While Surfbound uses security measures to protect your information, electronic communications carry inherent risks including transmission failures, unauthorized access, and data breaches. By using Surfbound, you acknowledge and accept these technology-related risks.

State Availability

Availability may vary by state, provider judgment, pharmacy availability, and applicable law. Not every treatment is available in every state. Not every user will qualify for treatment. Your provider will evaluate eligibility based on your location and applicable state regulations.

Communications Consent

Surfbound may communicate with you by email, phone, or other methods as permitted by law. SMS text messages are sent only where the user has separately provided the applicable SMS consent. Marketing and non-marketing SMS consent are optional and are not a condition of purchasing or using Surfbound services.

SMS consent is separate from any general communications consent and from any consent to telehealth services. Using Surfbound does not, by itself, constitute consent to receive SMS text messages. Withdrawal of Consent

You may withdraw your consent to telehealth services at any time by discontinuing use of Surfbound. Withdrawal of consent does not affect the lawfulness of any treatment or data processing that occurred before withdrawal. If you have an active prescription or treatment in process, withdrawal of consent does not cancel or refund that order.
